1. To provide an update to the Committees on the progress of the liquidations including the liquidators ' intentions to seek further document production and public examination orders against New Hope, PwC, Deloitte and certain employees as well as current and former officers of NEC and Colton Coal
2. To seek the Committee?s consent for the liquidators to enter two funding deeds with WICET in relation to:
(a) The costs of preparing and filing the application for special leave to the High Court of Australia to appeal the decision of the New South Wales Court of Appeal which dismissed NEC?s appeal in relation to the DOCG decision of Justice Stevenson (?High Court Funding Deed?) of 12 July 2019
(b) The costs of obtaining, and acting on, orders for further public examinations and document production to assist our investigations into the affairs of the Companies (?Public Examinations Funding Deed?)
3. To address any questions the Committees have in relation to the liquidations generally.
